We operate the website manico.mariuti.com (the ‘Site’), the macOS desktop application Manico (the ‘App’), as well as any other related products and services that refer or link to these legal terms (the ‘Legal Terms’) (collectively, the ‘Services’).

Manico is a keyboard-focused app switcher for macOS that helps you navigate between applications with lightning speed.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (‘you’), and Alexandru Florian Mariuti, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

PURCHASES AND PAYMENT

We accept payments through Paddle, our payment processor. You agree to provide current, complete, and accurate purchase information. All payment data is stored and processed by Paddle. You may find their privacy notice at: https://www.paddle.com/legal/privacy

Prices are displayed in USD. Sales tax may be added as required by your jurisdiction.

We reserve the right to refuse any order placed through the Services and to correct any errors in pricing.

REFUND POLICY

We offer a full refund within 14 days of purchase, no questions asked. To request a refund, please contact us at support@mariuti.com or request it directly through Paddle, our payment provider.

Refunds are processed through Paddle and will be returned to your original payment method. Please allow up to 10 business days for the refund to appear on your statement.

After the 14-day refund window, all sales are final.

SOFTWARE LICENSE

Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to download, install, and use the App on macOS devices that you own or control, for your personal or business use, in accordance with these Legal Terms.

You shall not: (1) decompile, reverse engineer, disassemble, or attempt to derive the source code of the App; (2) make any modification, adaptation, or derivative work from the App; (3) violate any applicable laws in connection with your use of the App; (4) remove any proprietary notices from the App; (5) use the App for any revenue-generating endeavour for which it is not designed; (6) make the App available over a network permitting access by multiple users simultaneously beyond what is licensed.

INTELLECTUAL PROPERTY RIGHTS

We are the owner of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, text, photographs, and graphics (collectively, the ‘Content’), as well as the trademarks, service marks, and logos (the ‘Marks’).

Our Content and Marks are protected by copyright and trademark laws. The Content is provided ‘AS IS’ for your personal, non-commercial use only.

DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

GOVERNING LAW

These Legal Terms are governed by the laws of Italy. You agree to submit to the non-exclusive jurisdiction of the courts of Turin, Italy.
